What is the R&D Tax Credit?

  • General business tax credit for companies incurring R&D expenses in the United States
  • Incentivizes companies to develop new and improved products and processes.  For architecture firms, the “product” is the design, either physical or digital
  • In addition to the Federal credit, about 40 states have their own initiative
  • The Credit offers up to 10 cents in benefit for every qualifying dollar identified, and a dollar-for-dollar reduction in tax liability
  • Can be captured retroactively and carried forward for up to 20 years

How Can Architects Benefit from the R&D Tax Credit?

  • Architecture is based on innovation, and as such many of an architect’s day-to-day activities are actually considered R&D
  • Architecture firms can claim qualified expenses, including wages paid to in-house employees who are performing qualifying activities
  • Firms may also claim 65% of wages paid to external contractors for services like testing, CAD modeling, or engineering
  • The resulting increased cash flow can be used to offset tax liability, grow the firm, or support future innovation

What Qualifying Activities do Architects Perform?

In a sense, the entire architectural design process can be considered a process of experimentation.

At a more granular level, qualifying activities include:

    • Developing new or improved designs
    • Designing building systems
    • Creation of feasibility studies, master plans, or schematic designs
    • Creating planning and elevation drawings
    • Evaluating alternative designs to address client requirements, building orientation, site limitations etc.
    • Evaluating alternative designs and materials to optimize a building’s energy-efficiency
    • Use of CAD or BIM modeling
